We invite you to enjoy DriversMeeting.com ("Site" or "Service"), keeping in mind that in order to ensure you the best experience, we ask that you agree to the following terms of engagement. If you don't agree with any of the terms, please do not use the Site.

The Base Rules:

• The first rule is that you may not use the Site for any unlawful purpose;
• Maintain a friendly and positive atmosphere by not being offensive or harassing and not posting any communications, pictures, videos or recordings which could contain libelous, slanderous, abusive or defamatory statements, or racist, pornographic, obscene, or offensive language or images;
• We respect your privacy and try to keep your information confidential; so we ask that you do the same with all information you get through the Site. Please don't give out private or confidential information to anyone else without first getting permission from the owner;
• Mutual respect of each other's rights, including privacy, property, or any other rights is expected at all times - our expectation is that you have the ownership rights or the necessary permission to whatever you post on the Site;
• We ask that you not use an ID or nickname that impersonates someone else, is protected by trade-mark or proprietary law, or is vulgar or otherwise offensive, as we may refuse you access to the Site;
• Please don't use the Site to forward chain letters, to post or distribute messages, pictures or recordings which don't belong to you or that could be seen as being fraudulent, misleading or unlawful - this includes not distributing or up loading any viruses or other harmful programs;
• Please keep in mind the primary purpose of DriversMeeting.com and don't use it to promote your business, advertise or solicit goods, services or funds - there exist other sites for that purpose;
• Please do not post or give out any of your contact information (like email addresses, "instant messenger" nicknames, telephone numbers, postal addresses, URLs, or your full name) on the publicly posted areas - this could be dangerous or cause problems for you later, besides which it goes against the whole concept of the Site which is to allow you to interact with other members without giving out your personal contact information.

Following these rules makes the experience better for all concerned. If you do anything that violates these rules or any other part of our Agreement, we may immediately end your access to the Site and any unused subscription time will automatically be given up and not refunded. If we end our relationship due to any illegal or unlawful activity by you, we may refer the situation to an appropriate law enforcement agency for further action.

To keep DriversMeeting.com relevant and up to date, we may add new features and modify or discontinue any aspect of the Site at any time. We may also impose limits on certain features and aspects of the Service or restrict your access to parts or all of the Service without notice or liability. If you are a non-resident of Canada then your right to access the Services, and in particular log-in or access any database, must be restricted to a location from outside of Canada. By law, we are required to expressly prohibit any use of our database by a non-resident of Canada from a location within Canada.

How We Charge:

We are a subscription based Site. Currently the subscription cost is Free, but this may change in the future. You can check us out, post a profile and browse our Site, all for free. We will charge you a monthly subscription fee (plus any applicable taxes1) if you want to send any messages, read any received messages or post on any forums. Your subscription covers all these things for 30 days, 90 days or 180 days depending on the subscription package you decide to purchase. Your subscription may be purchased online through a valid credit card and will be activated immediately upon verification of that card by our payment processor. Once purchased, and unless cancelled, your subscription automatically renews for a similar period of time, being charged to the credit card you originally used to purchase your subscription. You may cancel your subscription at any time. Instruction on how to do this can be found in our FAQ section at the bottom of every page. As long as you cancel at least 24 hours in advance of a renewal date, your subscription will end as of the next renewal date. Please note that all payments are final and that THE PURCHASE OF A SUBSCRIPTION IS NON-REFUNDABLE. Once you buy your subscription its only value is for the use of certain paid features on the Site, for the applicable purchased subscription period. We reserve the right to change our pricing policy at any time at our sole discretion. We also reserve the right to change payment methods at any time, at our sole discretion. In addition to the subscription price we may also be required to charge you taxes1, if applicable, which will be outlined to you prior to proceeding with the actual transaction. When you accept to proceed with the transaction you agree to pay all amounts in connection with your use of the Site (including any applicable taxes). Any costs required to access our Site, such as, but not limited to internet access or usage fees are your responsibility. We are not responsible if someone else uses your credit card, with or without permission, to pay for a subscription on our Site, and we will not refund you any such amounts.

Taxes

DriversMeeting.com is an Ontario Company with operations based in Ontario, and as such we are required to charge a Goods and Services Tax ("GST") on any subscription purchase made by a Canadian resident. DriversMeeting.com will charge and collect GST on any purchase made from a Canadian credit card, drawn on a Canadian account and/or from a Canadian location or address

Confidentiality:

An important part of the Agreement between us is DriversMeeting.com’s Privacy Statement which outlines what we do to keep your information private, how we use the information you give us and how and when we may contact you. At the same time, due to the nature of the Internet there are limits as to what we can do to maintain the security or privacy of any information you may provide through the Internet or your email messages. You agree that we cannot be responsible in any way for the use by others of any information which you post on the Site or provide to them. You should use caution in selecting the personal information you post or provide to others. Likewise, we assume no responsibility for the content of messages sent by other users of the Site, and you agree that we are not liable for those contents or communications.

Some of our features on the Site may email you publicly available information about other users. We cannot guarantee, and assume no responsibility for verifying, the accuracy of the information provided by those users, this includes information which we may provide directly to you but which has been posted or provided to us by other users.

We may also send you emails, for the purpose of letting you know of any changes or additions to our Service, or of any DriversMeeting.com related products and services.

Remember, your account is private to you and for security reasons you should not allow anyone else to use it. If you do give out your password, you are responsible for that person's activity on the Site using your account.

Monitoring the Site:

We reserve the right to monitor all advertisements, public postings, messages, video and audio recordings to ensure that they conform to the rules of the Site.

While we do not and cannot review every message or other material posted or sent by users, and claim no responsibility for any of this content, we may delete, move, or edit messages or materials, including without limitation profiles, public postings, messages, video and audio recordings that we may deem to violate this Agreement, or that we feel may be unacceptable. Your profile and/or any postings you place on the site are your sole responsibility at all times. By placing anything on or uploading anything to the Site you are promising that you have all the necessary rights and permissions to do so and that you have paid all the necessary fees or amounts owing. You also will hold us harmless from any and all costs (including legal fees) that we incur as a result of any breaches of this promise.

Once posted to the site, DriversMeeting.com can not prevent your pictures and video recordings from being copied or captured by unauthorized third parties, please keep in mind before you decide to post on the site. Please always remember, especially when posting pictures of friends and family members other than yourself, that there is a reason why it is called the World Wide Web.

In the virtual world as in real life there are people who are not honest and will not abide by the rules of our Site, and although we attempt to weed these people out, they may still manage to get through. We remind you that using the Site is at your own risk and we ask that you use the same caution in the virtual world as you would in the real world.

Ending Access to the Site:

You may end our relationship at any time by deleting your account and stopping access to the Site. Instructions to do this are located in our FAQ at the bottom of every page. We may end our relationship or stop any function or part of the Site at any time for any reason with or without notice to you.

There are times when the Site could become inaccessible due to any number of reasons and we are forced to suspend our Services. You agree that we cannot be held liable for any suspension of the Service, regardless of the cause of the interruption or suspension. Any claim against us shall be limited to the amount you paid, if any, for use of the Service during the previous 12 months. We may discontinue or change the Service or its availability to you at any time and you may stop using the Service at any time.

Copyright

The Site contains information which is proprietary to us, our partners and other users. We claim full copyright protection in the Site and the Service offered. Information posted by us, our partners or other users may be protected whether or not identified as proprietary. You agree not to modify, copy or distribute any such information in any manner whatsoever without having first received the express permission of the owner of such information.

You grant us a limited non-exclusive license to use any of your copyrighted material for the purpose of our being able to promote the site.

External Links and Advertisers

At times we may sell advertising space on the Site or add links to external sites ("External Links"). We are unable to pre-screen these External Links or any offers made by them, other than to assess whether they may be of interest to you as users, and so we ask that you take proper precautions prior to making any purchases or doing any other activities through these External Links. We suggest that you review the terms of use and privacy statement of such External Links prior to use of them.

Articles, Information and Postings

DriversMeeting.com will include, at times, a variety of extra information, such as advice columns, articles, discussion forums and blogs ("Information"). None of this Information should be taken in lieu of professional advice that you may seek out yourself.

Legal Aspects

We may modify this Agreement from time to time and we will notify you of those changes by posting them on the Site or sending you an email, or both. If you do not agree to any modifications, you should immediately stop using the Service. Your continued use of the Service constitutes a binding acceptance by you of this Agreement and any posted modifications.

You agree to indemnify us, our officers, directors, employees and agents, from any loss or damages, including without limitation reasonable legal fees, which we may suffer from your activities on or use of the Service, including without limitation any breach by you of this Agreement, including but not limited to the rules listed above or any charges or complaints made by other parties against you. You shall cooperate as fully as reasonably required in the defence of any claim. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you; provided, however, that you shall remain liable for any such claim.

The Service is distributed on an "as is" basis. We do not warrant that this Service will be uninterrupted or error-free. There may be delays, omissions, and interruptions in the availability of the Service. Where permitted by law, you acknowledge that the Service is provided without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

This Agreement is governed by the laws of the Province of Ontario and any case must be brought to the courts of Ontario or the Federal courts within Ontario. If any provision in this Agreement is found to be invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods. This Agreement is made with you specifically and so you may not transfer any of your rights or obligations to anyone else. DriversMeeting.com Corp. may assign any or all of its rights and duties under this Agreement or to the Service to any third party, in which case, as long as someone else has taken on the rights and duties, we may, at our election, be relieved of any further duties under this Agreement.
